Heard Mr. Ashish Tiwari, learned counsel for the petitioner as well as Mr. Praveen Das, learned Additional Advocate General, appearing on behalf of the State/respondents. 2. The present petition has been filed by the petitioner with the following relief(s):- “a) Issue a writ of certiorari or any other appropriate writ order or direction quashing the E- mail Communication dated 29.12.2025 as issued by Respondent No. 3 - Chief Engineer disqualifying the petitioner and/or, b) Issue a writ of mandamus or any other appropriate writ order or direction to the Respondents to consider the technical bid of Petitioner in the interest of justice and equity; and/or c) Pass any other order that this court may deem fit in the facts and circumstances of the case.” 3. Mr. Ashish Tiwari, learned counsel for the petitioner would submit that he has filed an application being I.A. No.03/2026 seeking withdrawal of the present writ petition, as subsequent developments have rendered the petition infructuous. It is submitted that during the pendency of the writ petition, the Printed from counselvise.com 3 respondents proceeded with the opening of the financial bids, in which the petitioner has been disqualified, thereby extinguishing the cause of action raised in the writ petition challenging the email communication dated 29.12.2025. 4. It is further submitted by Mr. Tiwari that in view of the aforesaid subsequent event, nothing survives for adjudication by this Court and continuation of the present proceedings would serve no useful purpose. As such, he prayed that the instant writ petition be dismissed as withdrawn. 5. Mr. Praveen Das, learned Additional Advocate General appearing for the State/respondents, has no objection to the prayer made on behalf of learned counsel for the petitioner. 6.
