SANJEEV PRAKASH SHARMA Order 31/01/2026 1. Heard learned counsel for both the parties. 2. A settlement agreement was entered into between the parties, wherein Clause 3.4 of the agreement requires any dispute between the parties to be settled through arbitration. It would be apposite to quote Clause 3.4 of the agreement as under: “3.4. This Settlement Agreement shall be governed by the laws of India. Any dispute between the Parties arising out of or relating to this Settlement Agreement, including with respect to the interpretation of any provision of this Settlement Agreement and with respect to the performance by the Parties of their obligations, shall be resolved by arbitration by a single arbitrator appointed by mutual written consent of the Parties. The arbitration proceedings shall be in accordance with the Arbitration and Conciliation Act, 1996 or any enactments in substitution thereof. The seat and venue of the arbitration proceedings shall be at Jaipur. The award of the arbitrator shall be final and binding upon the Parties and the Parties agree to be bound by the same. Both the counsel are ad idem that the dispute has arisen between the parties relating to settlement amount and requires to be examined by the Arbitrator. 4. With the consent of the parties, this Court directs appointment of Hon’ble Mr. Justice Manoj Kumar Vyas (Retd.), B- 145, Tara Marg, Hanuman Nagar, Jaipur to act as an Arbitrator and to decide all issues without prejudice to the rights and contentions raised in the present application and in the reply. The arbitration fees shall be in accordance with the Fourth Schedule of the Act of 1996, as amended. The fee of the Arbitrator will be equally borne by both the parties. The place of arbitration shall be at Jaipur. 5. The parties are at liberty to raise all objections before the Arbitrator including preliminary objections raised by the respondents. 6. The Arbitrator is requested to complete the proceedings as per time limit specified under Section 29A of the Act. 7. The arbitration application is allowed accordingly. 8.
