Dated this the 11th day of September, 2012 JUDGMENT Heard the learned senior counsel for the petitioner and the learned Standing Counsel appearing for the respondents. 2. Petitioner is a Charitable Trust which has established an Engineering College at Shornur. Exts.P1 and P2 are the orders passed against the petitioner in a penalty proceedings which were initiated under Section 271D of the Income Tax Act. Aggrieved by these orders, petitioner filed appeals which were rejected. Thereafter, petitioner filed Exts.P3 and P4 Appeals along with Exts.P3(a) and P4(a) stay petitions. Appeals were filed before the 2nd respondent. Although stay petitions were heard instead of passing orders thereon, Tribunal chose to hear the Appeals itself. Accordingly appeals were heard. However, in Ext.P5 order, there was difference of opinion between the members. As a result, the matter now stands referred to be heard by a 3rd member. In the meanwhile, Ext.P6 notice, demanding payment of the penalty and threatening of coercive action in the event of default, has been issued. This led the petitioner to file this writ petition. 3. Although the learned Standing Counsel appearing for the respondents contended that in the absence of any order of W.P.(C).20475/12 2 stay restraining the Department from realizing the amounts due under Exts.P1 and P2, they were entitled to have issued Ext.P6, fact remains that the appeals have been heard and in the peculiar circumstances pointed out, the matter now stands referred to be heard by a 3rd member. That apart, it is also submitted by the learned senior counsel for the petitioner that Rs.25,72,602/- has been paid by him. 4. In such circumstances, I dispose of this writ petition with the following directions. Tribunal shall expeditiously hear and pass orders on Exts.P3 and P4 appeals. In the meantime, subject to the petitioner remitting an amount of Rs.15,00,000/- within three weeks from today, further proceedings pursuant to Ext.P6 will be kept in abeyance.
