Therefore, he prayed that the miscellaneous application may kindly be allowed and appeal of the assessee may be restored to its original number. 3. A perusal of the contents of the miscellaneous application, clearly shows that the assessee has not been able to point out any error in the order of the Tribunal but is only trying to justify his non-appearance.
