VISWANETHRA RAVI, JM : This cross objection by the assessee against the order dated 10-07- 2017 passed by the Commissioner of Income Tax (Appeals)-4, Pune [‘CIT(A)’] for assessment year 2009-10. 2. We note that this cross objection was filed with a delay of 231 days. After hearing both the parties, we find that the reasons stated by the 2 CO No. 13/PUN/2021, A.Y. 2009-10 assessee are bonafide which really prevented the assessee to file the present appeal in time. Therefore, the delay of 231 days are condoned. 3. At the outset it is noted that the issues raised in this cross objection are similar to the issue raised in CO No. 7/PUN/2020. The ld. AR conceded that by mistake the assessee filed two cross objections on the same issues and prayed to dismiss the present cross objection i.e. CO No. 13/PUN/2021. Accordingly, the cross objection filed by the assessee is dismissed as withdrawn. 4. In the result, the cross objection of the assessee is dismissed.
