The notice sent to the address returned unserved. 3. It is found from the record that the Department of Revenue had filed Appeal in ITA No. 3062/Del/2018 challenging the order of the Ld.CIT(A) dated 22/05/2017 for Assessment Year 2009-10 which is also the impugned order in the present Cross Objection filed by the assessee. The Appeal filed by the Revenue in ITA No. 3062/Del/2018 has been dismissed by the Co-ordinate Bench of the Tribunal on 07/09/2018. 4. In view of the dismissal of the Appeal and confirming the order of the Ld.CIT(A) by the Tribunal, the adjudication of the Cross Objection filed by the assessee will not achieve in fruitful results. Therefore, we deem it fit to dismiss the Cross Objection filed by the assessee. Ordered accordingly. 5. In the result, Cross-objection filed by the assessee is dismissed.
