Case(s) called twice. None appeared for the assessee’s behest. It is accordingly proceeded ex-parte. ITA No. 690/Hyd/2019 C.O.No.22/Hyd/2019 :- 2 -: 2. It transpires at the outset that this assessee’s C.O.No.22/Hyd/2019 suffers from 27 days delay stated to be attributable to the reason(s) beyond its control. No rebuttal has come from the departmental side. The impugned delay is condoned therefore. 3. Coming to the Revenue’s appeal ITA No.690/Hyd/2019, learned departmental representative has filed letter dt.21-12- 2021 containing Form-5 issued by the prescribed authority under the Direct Tax Vivad Se Viswas Scheme 2020. 4. We therefore dismiss the Revenue’s instant appeal as having become infructuous. The assessee’s C.O.No.22/Hyd/2019 thereto is also disposed-of in the very terms. 5. This Revenue’s appeal ITA No.690/Hyd/2019 and assessee’s cross objection C.O.No.22/Hyd/2019 both are dismissed. A copy of this common order be placed in the respective case files.
