The assessee has raised following grounds in the cross-objection:- 1. “The Honorable CIT(Appeals)-10 has completely failed to adjudicate 15 grounds of appeal before him and submission made thereon by the appellant during the course of appeal. He has concluded the grounds of appeal preferred by the appellant hypothetically, summarily and hurriedly into 3 grounds at his sweet will and accordingly decided the matter without disposing off the each grounds of appeal. 2. The respondent craves leave to add, alter or amend any/all the grounds of appeal before or during the course of appeal.” 2. At the time of hearing, Ld. Counsel for the assessee submitted that under the instruction of the assessee, he does not wish to press the Cross-objection. The grounds raised in the cross-objection by the assessee are to be withdrawn. 2 | Page He submitted that by way of written submission dated 25.07.2022, same request was made. 3. Ld. Sr. DR for the Revenue has no objection in this regard. 4. We have heard Ld. Authorized Representatives of the parties and perused the material available on record. In view of the submissions made at Bar and written request made by the assessee for seeking withdrawal of the cross- objection, we hereby dismiss the cross-objection filed by the assessee as withdrawn. 5. In the result, the Cross-objection filed by the assessee is dismissed. Order pronounced in the open Court on 22 nd May, 2024.
