Dated this the 31st March, 2014 J U D G M E N T Being aggrieved of Ext.P2 assessment order passed by the first respondent/Assistant Commissioner of Income Tax in respect of the assessment year 2010-11, though the petitioner preferred appeal, it was dismissed by the second respondent/Commissioner of Income Tax(Appeals)as per Ext.P4 order dated 05.02.2014. Challenging Ext.P4 order, Ext.P5 second appeal along with Ext.P6 stay petition have been filed before the 3rd respondent/Income Tax Appellate Tribunal, which are pending. The petitioner is aggrieved of the coercive steps being pursued without any regard to the pendency of the above proceedings, as borne by Ext.P7. 2. Heard the learned Government Pleader as well. 3. Considering the facts and circumstances, the third respondent/Appellate Tribunal is directed to consider and pass appropriate orders on Ext.P6 petition for stay, in accordance with law, as expeditiously as possible, at any rate, within a period of 'six weeks' from the date of receipt of a copy of the judgment. W.P.(C)No.9404 OF 2014 2 It is made clear that till such orders are passed in Ext.P6 interlocutory application for stay, all further coercive proceedings pursuant to Ext.P7 shall be kept in abeyance. 4.
