The contents of the withdrawal application are reproduced hereunder: “Respected Sir, Most respectfully, it is submitted that the hearing of the above mentioned Appeal is fixed for 08 Aug 2023. In this regard I wish to submit that the appellant has already filed a Declaration under Vivad Se Vishvash Scheme and claimed a Refund of tax and penalty but amended Form No-3 has not yet received from the office of the Principal Commissioner of Income Tax ITA 1039/CHD/2019 A.Y.2010-11 Page 2 of 2 Chandigarh. The Appellant is hopeful that he will receive amended Form No 3 from the office of Principal Commissioner of income Tax Chandigarh. In view of the above you are therefore requested to accept my request for withdrawal of Appeal No.ITA.1039/Chandi/2019 Assessment Year 2010-11 and do needful. Please accept my request for withdrawal of appeal and oblige” 3. The ld. DR has posed no objection to the request of the assessee. 4. In view of the above facts and circumstances, the appeal of the assessee is dismissed as withdrawn. Said order was pronounced in the Open Court at the time of hearing itself. 5.
