RIPOTE, AM : This appeal is against Commissioner of Income Tax (Appeals)- 12, Pune’s order dated 30.07.2018 for assessment year 2015-16. 2. When the matter had come up for hearing, the ld. AR for the respondent-assessee filed a letter duly signed by the respondent-assessee dated 03.02.2022 seeking permission to withdraw the above captioned appeal on the ground that the issues involved in this appeal stand settled under the Vivad Se Vishwas Scheme, 2020. The respondent-assessee also filed copy of Form No.3 and Form No.4 issued by the Designated Authority i.e. Pr. Commissioner of Income Tax, Nashik-1. 3. On the other hand, the ld. Department Representative conceded the submission of the respondent-assessee and expressed no serious objection to permit the withdrawal of the revenue’s appeal by the respondent-assessee. 4. In the circumstances, we hereby grant permission to the respondent-assessee to withdraw the revenue’s appeal. Accordingly, the above captioned appeal stands dismissed Revenue by Shri Anurag Srivastava Assessee by Shri Sunil Ganoo Date of hearing 13-04-2022 Date of pronouncement 25-04-2022 ITA No.108/PUN/2019 2 as ‘withdrawn’. However, revenue will be at liberty to file M.A., in case, the Form No.5 could not be issued. 5. In the result, the appeal filed by the Revenue stands dismissed as ‘withdrawn’.
