This assessee’s appeal for assessment year 2018-2019, arises against the National Faceless Appeal Centre [in short the “NFAC”] Delhi’s Din and Order No. ITBA/NFAC/S/250/2022- 23/1047693621(1), dated 29.11.2022, involving proceedings u/s. 143(3) of the Income Tax Act, 1961 (in short “the Act”). Heard both the parties. Case file perused. 2. It emerges at the outset with the able assistance coming from both the parties that the Assessing Officer’s order in question dated 25.01.2021 forming subject matter of appeal before the NFAC had nowhere made any disallowance u/sec.36(1)(va) r.w.s.2(24)(x) 2 ITA.No.15/NAG./2023 of the Act. That being the clinching fact evident during the course of hearing, we hardly see any merit in the assessee’s instant appeal for want of valid cause of action. Learned counsel representing the assessee fails to rebut the same before us. 3. The impugned delay of 1077 days is condoned as per assessee’s solemn averments in light of Collector, Land Acquisition vs., MST Katiji [1987] 167 ITR 471 (SC) having settled the law long back that all such technical aspects must make a way for the cause of substantial justice. 4.
