Commissioner of Income Tax (Appeals), Jamshedpur both dated 07.03.2019 passed for the assessment years 2012- 13 and 2013-14. 2. At the time of hearing, ld. counsel for the assessee pleaded that the assessee has resolved the issue in dispute with the Revenue under Vivad Se Viswas Scheme. For buttressing this plea, the assessee has filed a copy of Declaration in Form No. 5 which is being placed on record. Since the Department has issued Form No. 5, which is the ultimate declaration for the resolution of the dispute with the assessee, therefore, there is no ideal to keep these appeals pending. Accordingly, we dismiss these ITA Nos. 154 & 155/PAT/2019 Assessment Years : 2012-2013 & 2013-2014 The National Cooperative Bank Limited 2 appeals of the assessee on the ground that dispute has been resolved under Vivad Se Viswas Scheme. 3. In the result, both the appeals filed by the assessee are dismissed. Order pronounced in the open Court on September 19, 2022.
