An application dated 29.10.2021, placed on record, is filed on behalf of the assessee for withdrawal of this appeal stating therein as under: To Dated 29-10-2021 The Hon'ble Members Income Tax Appellate Tribunal, Jodhpur Bench, Jodhpur. Re: Madhusudan Agarwal (PAN ACYPA2102R) Appeal No. ITA No. 16/Jodh/2020 (A.Y. 2015-16) Hon'ble Sir, The appellant had filed application under Vivad Se Vishwas Act, 2020 for settling the instant case and the Hon'ble PCIT (Admn), Jodhpur has issued Form No. 3 2 vide acknowledgement No. 935923880291220. Hence the appellant wishes to withdraw its captioned appeal in accordance with above said Act. You are kindly request to allow the appellant to withdraw the appeal and oblige. On perusal of the above application, we found that since the assessee has availed the immunity scheme i.e; Vivad Se Vishwas and the Income Tax Department has since issued Form No. 3 bearing acknowledgement No. 935923880291220, in response to the application filed by the assessee, under section 5(1) of the Direct Tax Vivad se Vishwas Act, 2020, therefore the assessee wants to withdraw the appeal. 4. The Ld. DR did not object if appeal of the assessee is dismissed as withdrawn. 5. In view of the above the appeal of the assessee is dismissed as withdrawn.
