At the outset, ld. AR of the assessee filed an application for withdrawal of appeal stating therein that the assessee has opted for Direct Tax Vivad Se Vishwas Scheme, 2020 before the appropriate authority and upon acceptance of the declaration, the issue has attained finality. Ld. AR has also filed copy of Form-I along with Fom-4 filed by the assessee before the competent authority and Form-3 issued by the department. It was also the submission of the ld. AR that status of Form-5 is awaited, therefore, he wants to withdraw the appeal. ITA No.186/RPR/2019 2 3. The ld. Sr. DR did not controvert the aforesaid factual position as had been canvassed before us. 4. Since the matter in issue has been settled under the Direct Tax Vivad Se Vishwas Scheme, 2020, therefore, the permission as sought is granted and the appeal of the assessee is dismissed treating the same as withdrawn. 5. In the result, the appeal of assessee is dismissed. Order pronounced in the open court on 26/07/ 2022.
