Realizing this mistake, the assessee has prayed for withdrawal of the said appeal stating as under : “Subject : Request for the withdrawal of appeal filed against the penalty order 271(1)(c)for the Assessment Year 2015-16. Sir, It is submitted that this appeal has been filed wrongly not lies with the ITAT, in fact had to be filed before the Commissioner of Income Tax Appeals.
