At the time of hearing of the appeal the Ld. Authorized Representative (in short ‘AR’) for the assessee submitted that as instructed he seeks liberty for withdrawing the present appeal. Ld. AR in support of his aforesaid claim had placed on record a letter dated 09.02.2022. 3. Per contra, the Ld. Departmental Representative (in short ‘DR’) did not raise any objection to seeking of withdrawal of the present appeal by the assessee. 4. We have heard the ld. Authorized Representative of both the parties and perused the withdrawal application filed by the Ld. AR. In view of the aforesaid facts, we permit the assessee to withdraw the present appeal. 3 ITA No. 333/RPR/2016 A.Y.2012-13 5. Resultantly, the appeal filed by the assessee is dismissed as withdrawn.
