ITA(TP)no.391/AHD/2016 A.Y.2011-12 2 2.Therevenuehasraisedfollowinggroundsofappeal: ThattheHon’bleDRPhaserredinlawandonfactsindeletingtheupward adjustmentofRs.58,38,170/-madebytheTPO,AhmedabadinrespectofArm’sLength Priceofinternationaltransaction. 3.Atthetimeofhearing,itwassubmittedbytheLd.ARfortheassesseethat appealfiledbytheRevenueishitbyrecentlyissuedCBDTCircularNo.17of2019 dated08/08/2019revisingthepreviousthresholdspertainingtotaxeffects.Asper theaforesaidCircular,allpendingappealsfiledbyRevenueareliabletobe dismissedasameasureforreducinglitigationwherethetaxeffectdoesnot exceedtheprescribedmonetarylimitwhichisnowrevisedatRs.50Lakhs.Inthe instantcase,thetaxeffectonthedisputedissuesraisedbytheRevenueisstated tobenotexceedingRs.50lakhsandtherefore,theappealoftheRevenueis requiredtobedismissedinlimine. 4.TheLearnedDRfortheRevenuefairlyadmittedtheapplicabilityofthe CBDTCircularNo.17of2019.Accordingly,theappealoftheRevenueisdismissed asnotmaintainable.However,itwillbeopentoRevenuetoseekrestorationofits appealwithinthestipulatedtimeshowingtheinapplicabilityoftheaforesaidCBDT Circularinanymanner. 5.Intheresult,theappealoftheRevenueisherebydismissedduetolowtax effect.
