The relevant contents of such letter reads as under : “Above referred appeal is scheduled for hearing before Hon’ble “A” Bench on 10.01.2022. This appeal is filed against the order passed u/s 263 of Income Tax Act, 1961 subsequently to this order Ld. AO has taken up the matter and passed order U/s 143(3) r.w.s. 263 dt 28.04.2021 and in the said order after due verification of documents appellant’s Assessee by Shri Pramod Shingte Revenue by Shri Mohit Jain Date of hearing 10-01-2022 Date of pronouncement 10-01-2022 ITA No.412/PUN/2020 2 contention has been allowed, in view of the same your appellant intends to withdraw this appeal and pray accordingly.” 3.
