We find the appeal by the assessee was filed with a delay of 429 days. On perusal of record and hearing the ld. DR, we deem it proper to condone the delay of 429 days in view of the fact that the issue involved in 2 ITA No.490/PUN/2018, A.Y. 2009-10 this appeal has been settled through Vivad Se Vishwas Scheme. Therefore, the delay of 429 days is condoned. 3. On perusal of the letter filed by the assessee, we note that the assessee wishes to withdraw the appeal in view of having filed application under Vivad Se Vishwas Scheme proof of which the Form No. 5 is enclosed before this Tribunal. 4. Shri Vitthal Bhosale, the ld. DR has no objection in case the assessee wishes to withdraw the appeal. 5. In view of the request made by the assessee the appeal is dismissed as withdrawn.
