Appellant Respondent आदेश / ORDER PER INTURI RAMA RAO, AM: This is an appeal filed by the assessee directed against the order of the National Faceless Appeal Centre (‘NFAC’), Delhi dated 22.10.2021 for the assessment year 2018-19. 2. When the matter had come up for hearing, the ld. AR for the assessee filed a letter dated Nil seeking permission to withdraw the above captioned appeal. The relevant contents of the said letter are as under :- “The above referred appeal is scheduled for hearing before Hon’ble A Bench on 9 th January 2023. In this appeal your appellant has also filed rectification application u/s 154 which has been processed and Learned Assessing Officer has passed rectification order u/s 154 and Assessee by : Shri Pramod S. Shingte Revenue by : Shri Ramnath P. Murkunde Date of hearing : 09.01.2023 Date of pronouncement : 11.01.2023 ITA No.53/PUN/2022 2 carried out necessary rectification, therefore we intend to withdraw this appeal and we pray before Hon’ble bench to allow the withdrawal.” 3. On the other hand, the ld. Department Representative has no serious objection to permit the withdrawal of the appeal. 4. In the circumstances, we hereby grant permission to the appellant to withdraw the appeal. Accordingly, the above captioned appeal stands dismissed as withdrawn. 5.
