GARG, JM: This appeal filed by the assessee is directed against the order dated 24.03.2021 of the National e-Assessment Centre, Delhi, relating to Assessment Year 2016-17. 2. At the time of hearing, the authorized representative of the assessee, vide his letter dated 11.10.2022, submitted that the assessee had received two notices ITA No.576/Del/2021 2 of hearing for the same assessment year, and, on enquiry, it was informed by the Registrar, ITAT, that the instant appeal is a duplicate appeal and another appeal for the same assessment year exists with ITA No.524/Del/2021 and, as such, the duplicate appeal needed to be withdrawn. It was, therefore, requested by the ld. AR that the assessee may kindly be allowed to withdraw the instant appeal. 3. The ld. CIT-DR has no objection to the withdrawal of the appeal by the assessee. 4. On careful consideration of the submissions of the ld. AR, we find that one more appeal for the same assessment year exists with the Delhi Benches of the Tribunal and the instant appeal is a duplicate one of the said appeal, which was last fixed for hearing for 04.10.2022 and which now stands adjourned to 29.11.2022. In view of this, we allow the assessee to withdraw this appeal. 5. In the result, the appeal filed by the assessee is dismissed as ‘withdrawn.’ Order pronounced in the open court on 11.10.2022.
