Learned counsel for the assessee, at the time of hering filed an application seeking withdrawal of the appeal on the ground that consequential order u/s. 143(3) r.w.s. 263 r.w.s. 144B has already been passed in favour of the assessee. Therefore in the absence of any objection from the learned Departmental Representative, the appeal filed by the assessee is dismissed as withdrawn. 3.
