The assessee filed an application seeking permission to withdraw the present appeal. The relevant extract of the application reads as under : “1. The appellant has filed an appeal for the A.Y. 2022-23 bearing ITA No. 785/PUN/2022 and the same is fixed for hearing on 02.02.2023. 2 ITA No. 785/PUN/2022, A.Y. 2022-23 2. The appellant does not wish to pursue the litigation and therefore would like to withdraw the said appeal. 3. It is therefore requested that appellant should be given permission to withdraw the said appeal. With sincere apologies for the inconvenience caused.” 3. Shri Keyur Patel, the ld. DR reported no objection in case the assessee wishes to withdraw the appeal. 4. In view of the request made by the assessee the appeal is dismissed as withdrawn.
