M.L.MEENA,AM The present appeal has been filed by the assessee against the order of ld. PCIT, Chandigarh-1 dated 27.03.2021 pertaining to assessment year 2015-16. 2. The ld. counsel for the assessee vide application dated 31.12.2022 submitted that the assessment order u/s 143(3) consequent to revisionary order u/s 263 has been passed by the Ld. AO wherein no addition has been made after considering the arguments and evidences filed by the assessee. It is humbly requested therein that it has rendered the subject appeal as infructuous. He has enclosed copy of the assessment order passed for the ITA 91/CHD/2022 A.Y. 2015-16 Page 2 of 2 assessment year under consideration. Therefore, it was prayed that the permission may please be granted for withdrawal of the subject appeal with a liberty to get the appeal revived, if the department intends to re-open the assessment at any future date. 3. The ld. DR has no objection to the request of the ld. counsel. 4. Accordingly, we accept the request of the assessee for withdrawal of the subject appeal with a liberty to get the appeal revived, if the Department re-open the assessment. 5.
