Seethalakshmi, JM: This appeal filed by assessee is arising out of the order of the Learned Commissioner of Income Tax (Appeals)-1, Udaipur dated 04.08.2017 [here in after “ld.CIT(A)”] for assessment year 2013-14 which in turn arise from the order dated 30.03.2015 passed under section 143(3) of the Income Tax Act, by the ITO, Udaipur. 2. At the time of hearing of these appeal, ld. counsel for the assessee submitted that on the instruction of the assessee, he wish to withdraw the I.T.A. No. 94/Jodh/2018 M/s Nav Bharat Industries 2 appeal. In token of having ‘withdrawn’ the appeal, the ld. counsel for the assessee has put his signature on the appeal. Therefore, he requested that assessee may be allowed to withdraw these appeal. 3. The ld. DR has not objected to the withdrawal of the appeal. 4. We have heard both the representative of the parties. The assessee is allowed to withdraw the appeal. We, therefore, dismissed the appeal of the assessee as withdrawn. In the result, appeal of the assessee is dismissed as withdrawn.
