Heard Mr. K.R.K.V.Prasad, learned counsel for i petitioner and the learned Deputy Solicitor GenerAl of India appearing for resPondents- 3. Learned counsel for the petitioner contended that ttre petitioner was appointed as 'Income Tax Ofhcer' and at the time of his entry, his date of birth was entered incorrectly as 13.06.1956 instead of 13.12.1957. The petitioner has further contended that he has hled O.S.No.294 of 1981 before the Principal / I : t I a : : i i t I i l I ! a l A(s,J & RRN,J wp_I1808 2016 District Munsif, Eluru seeking correction of date of birth from 13.06.1956 to I3.L2.t957 and the said suit was decreed in favour of the petitioner vide orders, dated 28.09.1981 and the petitioner has submitted an application to correct his date of birth to tlre respondents from 13.06. 1956 to 13.L2.L957 in terms of the decree passed by the Competent Civil Court and the respondents have rejected the said application vide orders, dated 05.03.20 15 contending that the application seeking correction of date of birth was not submitted within hve (5) years and at a belated stage. Aggrieved by the said rejection orders, the petitipner I has approached the Tribunal by iitire O.A.No.O2 1/00726 of 2015 and the Tribunal was pleased to dismiss the O.A. vide orders, dated 26.02.2016 without appreciating any of the contentions raised by the petitioner. Therefore, appropriate orders be passed in the writ petition by setting aside the rejection orders passed by the respondents on 05.03.2O15 and also orders passed by , li ,i ll i AKs,J & RRN,J 1r'p I 1808_2016 the Tribuna-l ln O.A.No.021l00726 of 2015, dated 26.02.2016 and allow the writ petition. 4. On the other hand, the learned Deputy Solicitor General of India appearing for respondents had contended that the petitioner has approached the respondents at the fag end of his career seeking correction of date of birth and though the Competent Civil court has passed decree way back in 1991. He has not taken any steps to hle an application seeking correction of date of birth at the earliest point of time. Since, it is only at the fag end of career of the petitioner, seeking correction of date of birth is not permissible and the Tribunal was pleased to disrhiss the O.A. Therefore, there are no merits in the writ petition and the same is liable to be dismissed. 5. This Court, having considered the rival submissions made by both the parties, is of the view that the petitioner though obtained a decree way back in 1991 from the Competent Civil Court, he has not 3 { I I I taken any steps to see that his date of birth is AKs,J & RRN,J wp-118O8_2O16 corected at the earliest point of time. Since, he is seeking correction of date of birth at the fag end of his career, the Tribunal was justified in dismissing the O.A. Therefore, this Court is not inclined to interfere with the orders passed by the Tribunal. 6. With these observations, the Writ Petition is dismissed. No costs. 7.
