In its application, the assessee company through its director moved an application requesting for withdrawal of Miscellaneous application, the application states as under:- “Respected Sirs, 1. The above mentioned Miscellaneous Application of the assessee has been fixed for hearing before Hon’ble Bench. 2. In this regard, it is humbly submitted that the assessee does not wish to pursue the MA and therefore, it may kindly be permitted to withdraw the same. Miscellaneous Application may kindly be treated to have been withdrawn. During the course of hearing, the ld. AR appearing on behalf of the assessee and confirmed the facts. The ld. AR further submitted that the application has been signed by the director of the company and based on this application the MA filed by the assessee company is required to dismissed as withdrawn. Au contraire, ld. DR has no also stated his no objection allowing the assessee to withdraw this MA. Hence, the Bench allows the assessee to withdraw this MA.
