I have heard rival contentions and gone through facts and circumstances of the case. I noted that the Tribunal has dealt with the addition of sundry debtors realized at Rs.6.5 lakhs and timber 2 M.A No.107/CHNY/2023 dealing commission of Rs.3 lakhs vide para 5, wherein it is noted that the sundry debtors realized of Rs.1.35 lakhs and commission earned on account of timber dealing amounting to Rs.3 lakhs have already been declared in the return of income. By noting this fact, the Tribunal while allowing relief, stated as “Accordingly, I accept source of cash deposit as explained only to the extent of Rs.3.35 lakhs and balance amount is confirmed i.e., Rs.9.15 lakhs.”, whereas the total of Rs.3 lakhs of timber dealing plus Rs.1.35 lakhs of sundry debtors realized comes to Rs.4.35 lakhs instead of Rs.3.35 lakhs relief given in para 6. Hence, I treat the explained amount at Rs.4.35 lakhs instead of Rs.3.35 lakhs and balance amount confirmed is Rs.8.15 lakhs. I rectify the mistake accordingly. 3. In the result, the miscellaneous application of the assessee is allowed.
