MANJUNATHA, AM: The present Miscellaneous Petition is filed by the Revenue against order of this Tribunal dated 02.12.2019 in ITA No.2450/Chny/2018 relevant to the assessment year 2013-14. 2. We have heard both the parties and considered relevant contents of Miscellaneous Application filed by the Revenue and we find that the Tribunal has disposed off the appeal filed by the Revenue on low tax effect in light of CBDT circular No.17/2019 dated 08.08.2019. The Revenue now points out actual tax effect involved in the instant case is Rs.51,35,890/-, 2 M.A. No.109 /Chny/2019 which is more than the prescribed limit. Therefore, we are of the considered view that there is merit in the Misc. Application filed by the Revenue against order of the Tribunal in ITA No.2450/Chny/2018 dated 02.12.2019 and thus, we recall order of the Tribunal in ITA No.2450/Chny/2018 dated 02.12.2019 and direct the Registry to fix appeal for hearing on 10.10.2022. Since, order is pronounced in open court, no separate notice of hearing shall be issued. 3. In the result, Miscellaneous Application filed by the Revenue is allowed.
