MANJUNATHA, AM: The present Miscellaneous Petition is filed by the Revenue against order of this Tribunal dated 02.01.2019 in ITA No.2512/Chny/2018 relevant to the assessment year 2014-15. 2. We have heard both the parties and considered relevant contents of Miscellaneous Application filed by the Revenue and we find that the Tribunal has disposed off the appeal by the Revenue on low tax effect in light of CBDT circular No.3/2018. The Revenue now points out issue involved in appeal comes under exception as provided under said circular, because the 2 M.A. No.123 /Chny/2019 assessment has been reopened on the basis of Revenue Audit Objection raised by the Revenue Audit, which has been accepted by the Department for which the learned D.R. has filed relevant details of Revenue Audit Objection and acceptance by the Assessing Officer. Therefore, we are of the considered view that there is merit in the Misc. Application filed by the Revenue against order of the Tribunal in ITA No.2512/Chny/2018 dated 02.01.2019 and thus, we recall order of the Tribunal in ITA No.2512/Chny/2018 dated 02.01.2019 and direct the Registry to fix appeal for hearing in regular course. 3. In the result, Miscellaneous Application filed by the Revenue is allowed.
