DURGA RAO, JUDICIAL MEMBER: By means of present Miscellaneous Petition, the assessee seeks to recall the order passed by the Tribunal in I.T.A. Nos.2090, 2091 & 2092/Chny/2018 dated 22.05.2019 relevant to the assessment years 2009-10, 2010-11 & 2011-12. 2. When the Miscellaneous Petitions were taken up for hearing, the ld. Counsel for the assessee has submitted that after filing of these MPs, the assessee has opted Vivad-se-Vishwas Scheme 2020 and settled all the M.P. Nos.153-155/Chny/19 2 issues and prayed that the assessee may be permitted to withdraw the MPs filed by it, against which, the ld. DR has not raised any objection. 3. We have heard both the sides. Considering the prayer of the ld. Counsel for the assessee that the assessee has opted for Vivad-se- Vishwas Scheme 2020 and settled the tax disputed in its appeals and moreover, the ld. DR has not raised any objection, we are of the considered opinion that the MPs filed by the assessee are liable to be dismissed. Accordingly, the MPs filed by the assessee are dismissed as withdrawn. 5. In the result, all the miscellaneous petitions filed by the assessee are dismissed.
