However, on the date of hearing, the ld. counsel for the assessee vide application dated 01.01.2022 has prayed for a withdrawal of the present Miscellaneous Application filed. The contents of the application read as under : M.A. 18/CHD/2019 In ITA 294/CHD/2018 Page 2 of 2 “Hon'ble Members The above case is fixed for hearing on 02.02.2022. As I am suffering from severe cola and chest infection (bronchitis) since last 15 days and I am not able to attend to the professional work in full strength. I have also gone through detailed testing as advised by doctors. Due this reason I am unable to present before your honor. Moreover the appellant in the above matter has opted for DTVSV-Scheme. We are enclosing Form 5 i.e. order for Full and final settlement of tax arrears issued by the designated authority. A humble prayer is made to kindly allow us the withdrawal of Miscellaneous application in the above matter.” 3. The ld. Sr.DR had no objection to the said prayer. 4. In view of the facts as set out herein above, the Miscellaneous Application filed by the assessee is dismissed as withdrawn. Said order was pronounced at the time of virtual hearing itself in the presence of the parties via Webex. 5. In the result, the Miscellaneous Application filed by the assessee is dismissed as withdrawn. Order pronounced on 4 th March,2022.
