The ld. Counsel for the assessee reiterated his submissions as made in the application. He contended that the appeal was dismissed ex parte qua the assessee. He submitted that there was an inadvertent mistake on the part of the counsel for the assessee in recording the date of hearing. Therefore, the date of MA No.242/Del/2023 2 hearing was not correctly recorded by the counsel for the assessee. The ld. Counsel enclosed the relevant sheets of his diary. 3. On the other hand, the ld. DR opposed the submissions of the ld. Counsel of the assessee and contended that there is no reasonable cause. 4. I have heard the rival contentions and perused the material available on record. For the reasons stated in the application and to subserve the principles of natural justice, I hereby recall my order passed ex parte qua the assessee dated 23.05.2023. The Registry is directed to fix ITA No.566/Del/2022 at its original number in due course of time. 5. In the result, the Miscellaneous Application filed by the assessee is allowed.
