Counsel for the assessee submitted that the present Misc. application is arising out of the order dated 13/12/2018 of this ITAT, Jaipur Benches, Jaipur in ITA No. 390/JP/2018, against the said order of the ITAT, the assessee preferred appeal before the Hon’ble Jurisdictional High Court which was dismissed vide order dated 19/07/2019 in Appeal No. 53/2019 and thereafter, the MA 25/JP/2019_ M/s Krish Homes P Ltd. Vs ITO 2 Special Leave Petition bearing No. 38025/2019 filed by the assessee was also dismissed by the Hon’ble Apex Court vide order dated 06/12/2019. Therefore, this Misc. application by the assessee is to be treated as withdrawn. 3. The ld. DR did not object if the Misc. application filed by the assessee is to be dismissed as withdrawn. 4. In view of the above, this Misc. application filed by the assessee is dismissed as withdrawn. 5. In the result, this Misc. application is dismissed.
