(Applicant) (Respondent) For Revenue : Shri Umesh Phade For Assessee : -None- Date of Hearing : 15.12.2023 Date of Pronouncement : 15.12.2023 ORDER This Revenue’s miscellaneous application M.A.No.29/PUN./2023 filed u/s.254(2) of the of the Income Tax Act, 1961 (in short "the Act"), seeks to recall/rectify our order dated 30.05.2022 allowing assessee’s main appeal ITA.No.243/PUN./2020 for assessment year 2011-2012. Case called twice. None appears at assessee’s behest. He is accordingly proceeded ex-parte. 2. It emerges at the outset that this tribunal on the one hand has accepted the assessee’s main appeal ITA.No.243/PUN./2020 vide order dated 30.05.2022 despite the fact the sole issue of long term capital gains raised therein already stood settled under the Direct Tax Vivad se Vishwas 2 MA.No.251/PUN./2023 Scheme 2020 [“VSVS”]. The Revenue has also filed the corresponding Form-5 on record. That being the case, this tribunal treats the foregoing impugned order dated 30.05.2022 has an apparent mistake on record u/sec.254(2) of the Act in light of hon’ble apex court’s recent landmark decision in ACIT vs. Saurashtra Kutch Stock Exchange Ltd., [2008] 305 ITR 227 (SC); CIT vs. Reliance Telecom Ltd., [2021] 133 taxmann.com 41 (SC). Ordered accordingly. 3. This Revenue’s miscellaneous application M.A.No.29/PUN./2023 is allowed whereas the assessee’s main appeal ITA.No.243/PUN./2020 is dismissed in very terms.
