MANJUNATHA, AM: The Revenue has filed present Miscellaneous Application against order of the Tribunal in ITA No.1492/Chny/2019 dated 28.08.2019 and requested to recall order for reasons stated in the Misc.Application filed for the assessment year 2015-16. 2. None appeared for the assessee. We have heard learned DR and considered Miscellaneous Application filed by the Revenue against order of the Tribunal in ITA No.1492/Chny/2019 dated 28.08.2019 and we find there is no 2 Misc.Petition No.30/Chny/2020 merit in the application or ground taken by the Revenue, because the Revenue seeks to review order passed by the Tribunal on the issue of computation of capital gains derived from sale of shares in the guise of mistake apparent on record as stated u/s.254(2) of the Income Tax Act, 1961, which is not permissible under the Act. Therefore, we are of the considered view that there is no merit in the Misc. Application filed by the Revenue and thus, same is dismissed. 3. In the result, Misc. Application filed by the Revenue is dismissed.
