The present Miscellaneous Application (“M.A.”) has been filed by the Revenue under section 254(2) of the Income Tax Act, 1961 (“the Act”) seeking recall of the order dated 25/05/2022, passed under section 254(1) of the Act by the Co–ordinate Bench of the Tribunal in assessee’s appeal being ITA no.414/Mum./2022, for the assessment year 2019–20. 2. From the perusal of record, we find that the copy of the order dated 25/05/2022, passed by the Co-ordinate Bench, was received by the Pr. Commissioner of Income Tax-1, Mumbai on 20/09/2022. From the perusal of Brill Pharma Pvt. Ltd. M.A. no.348/Mum./2023 Page | 2 the record, we find that the present miscellaneous application was filed by the Revenue on 03/05/2023. As per the provisions of section 254(2) of the Act, the limitation period for filing the miscellaneous application seeking rectification of any mistake apparent from the record is 6 months from the end of the month in which the order is passed. Even by adopting the liberal interpretation and computing the limitation period from the end of the month in which the order is communicated to the Revenue, the limitation period in the present case for filing the miscellaneous application under section 254(2) of the Act expired on 31/03/2023. Further, under the Act, the Tribunal is not empowered to admit the miscellaneous application filed after the time period provided under section 254(2) of the Act. Therefore, in view of the above, the present miscellaneous application is dismissed in limine being barred by limitation. 3.
