Hence, the Revenue has requested that the Tribunal’s order in I.T.A. No.2004/Chny/2019, dated 09.09.2019 be recalled. :: 2 :: M.A. No.41Chny/2020 [In I.T.A. No.2004/Chny/2019] 2. When these facts were confronted to the learned Counsel for the Assessee, she fairly agreed. 3. After hearing the rival contentions and on going through the facts and circumstances of the case, we recall the order of the Tribunal and direct the Registry to fix this appeal. For this, the appeal is fixed for hearing on 05.09.2022. Since the order of the Miscellaneous Application is pronounced in the open court, no separate notice shall be served to either party. 4. In the result, the Miscellaneous Applications in M.A. No.41 /Chny/2020 of the Revenue is allowed. Order pronounced in the court on 22 nd July, 2022 at Chennai.
