Pursuant to the direction passed by us on 25.03.2022 the Revenue has filed written notes of submission dated 04.05.2022 along with the supporting documents from which it appears that the Ld. DR to submit the copy of the order of approval of Revenue Audit Objection and the connected documents so as to ascertain that the examination of the merit of the matter has been properly done by the Department or the appeal has been preferred in a mechanical manner. Pursuant to - 2 - MA No.53/Ahd/2020(In ITA No.2350/A/18) ACIT vs. M/s. Apex Dye Stuff Industries Asst.Year – 2012-13 such order the Ld. D. R. filed his written notes of submission annexing the relevant documents for preferring the instant application. 3. Upon perusal of the same, it appears that due application of mind has been done by the Department in preferring this application for recalling of the order passed by the Coordinate Bench. Hence, the Miscellaneous Application filed by the Revenue is allowed. The Registry is directed to fix the matter afresh for hearing upon notice to the respective parties. 4. In the result, Misc. Application filed by the Revenue is allowed.
