Flax Apparels Pvt.. Ltd. Asst.Year – 2013-14 2. None appeared on behalf of the assessee at the time of hearing of Miscellaneous Application. 3. However, audit objection has been raised to this effect that the assessee’s claim of service tax refund waived was allowed by the Ld. AO although the same was not related to current year but related to F.Y. 2011-12 and earlier years and therefore not allowable as deduction under Section 37 of the Act. Upon which, reopening under Section 147 of the Act was done. The Ld. DR has appraised us about the fact of acceptance of such audit objection by the department which is reflected in the letter written by the Ld. AO dated 22.11.2017. In that view of the matter, the application is allowed. The matter is directed to be taken up for hearing on 12.09.2023. Notice to this effect to be served upon the assessee by the Registry. 4. In the result, Miscellaneous Application preferred by the Revenue is allowed.
