Sridhar, Advocate स ु नवाई कȧ तारȣख/ Date of hearing : 05.08.2022 घोषणा कȧ तारȣख /Date of Pronouncement : 05.08.2022 आदेश /O R D E R PER MAHAVIR SINGH, VP: By way of this Miscellaneous Application, Revenue seeks recalling of Tribunal order passed in ITA No.2675/CHNY/2019 dated 09.03.2022. 2. Drawing attention to para 5 of Tribunal order, the ld.DR submitted that the table extracted therein do not pertain to the assessee as is evident from the order of ld.CIT(A). The ld.DR submitted that the conclusion based on the basis of the same is erroneous. The ld.AR, on 2 M.A No.72/CHNY/2022 the other hand, submitted that the issue is estimation of profits only and therefore, the same would not have material bearing on the adjudication. 3. Having heard rival submissions, we concur with the submissions of the Revenue that the conclusion has been drawn on the basis of wrong assumption of facts. Therefore, we recall the Tribunal order passed in captioned appeal ITA No.2675/Chny/2019 on 09.03.2022. The appeal shall come up for hearing on 14.09.2022 before regular Bench. Both sides informed and therefore, separate notice is dispensed with. 4. In the result, the miscellaneous application of the Revenue is allowed.
