Date of hearing: 17/12/2021 Date of Pronouncement: 27/12/2021 PER ANIL CHATURVEDI, ACCOUNTANT MEMBER: The present Miscellaneous Application (MA) is filed by the Revenue in respect of consolidated order of Tribunal dated 18.09.2017 in ITA No.5957/Del/2010 for A.Y. 2007-08 & ITA No.4260/Del/2012 for A.Y. 2008-09. 2. Before us, Learned DR submitted that the aforesaid appeals was for A.Y. 2007-08 & 2008-09, but inadvertently in Para 19 of the order, it is stated that the appeal for Revenue for A.Y. 2009-10 is dismissed. He therefore submitted that the aforesaid mistake which is apparent from record be rectified in the order passed on 18.09.2017. Page 2 of 3 3. The Learned AR on the other hand did not controvert the submissions made by Learned DR. 4. We have heard the rival submissions and perused the materials available on record. We find that inadvertent typographical error has crept in the Tribunal order dated 18.09.2017 in ITA Nos.5957/Del/2010 & 4260/Del/2012 for Assessment Years 2007-08 & 2008-09 wherein in Para 19 it is stated that the appeal for Revenue in Assessment Year 2009-10 is dismissed. 5. We therefore amend the aforesaid order wherein the reference to the assessment year should be 2007-08 & 2008-09 instead of 2009- 10 and therefore the paragraph No.19 should now be read as under: “In the result, appeals of the Revenue for Assessment Years 2007-08 & 2008-09 are dismissed.” 6. In the result, both the Miscellaneous Applications of the Revenue are allowed.
