The instant Writ Petition has been filed by the petitioner under Articl e 226 of the Constitution of lndia seeking for the following relief: \"to poss on order or direction especiolly one in the noture ol wRlT oF MANDAMUS hotding thot the otder possed by 1st Respondent u/s 747 r w s 7448 of the Act dt 08/02/2024 with DtN No TTBNAST/S/147/2023- 24/1060641387(1) for the Ay 2078-79 os orbitiorv, illegol, bod in low, void ob initio, oport Irom being violotive of provisions oI section 7484 ond section 749 of the Act ond olso contrary to the circulor issued by CBDT ond provisions ol section 151A oJ the Act ond con*quently set oside the some in the interests ol iustice\". 3. One of the contentions that the petitioner has raised in the present Writ Petition is that under the amended of the Act which carne into effect from I provisions 2 PSI(,J & MTR,J W.P.No.562O of 2024 Ol.O4.2O2l, the respondents, while proceeding under Section 148 of the Act, were required to issue notice under Section 148.A and provide an opportunity of hearing to the assessee. As per the amended pror.ision of law, the proceedings to be drawn are also in a faceless manner. 4. Whereas, learned counsel for the petitioner contended that, in the instant case, reopening has been initiated by the Jurisdictiona-l Assessing Officer. In support of his contention, he relied upon the recent judgment rendered by this very Bench in WP.No.259O3 of 2022 & batch, dated 14.O9.2023 wherein this Court disposed of the batch of writ petitions to the limited extent. 5. On the other hand, learned Standing Counsel for the respondent-Department does not dispute that the said objection was decided in the aforesaid batch of Writ Petitions. However, he further contended that apart from the aforesajd objection, there have been other various objections also which the petitioner has raised in the writ petition. PSK,J & NTR'J W.P.No.562O oJ 2O24 6. So far as this contention of the leamed counsel for the respondent-Depa-rtment is concerned' this Bench' while disposing of said batch of writ petitions' had taken note of the same at paragraph Nos'37 & 38 which are reproduced 3 herein under: \"37.
