The ld. Counsel appearing for the assessee submitted that while deciding identical claim of deduction u/s. 54 of the Act in case of assessee’s wife, the Assessing Officer (‘A.O.’ for short) himself has allowed the claim. Thus, he submitted, assessee has strong prima facie case. Further, he submitted, assessee has paid more than 20% of the outstanding demand in the meanwhile. Having considered rival submissions and perused the materials available on record, we are convinced that the assessee has made out a prima facie case in his favour. The balance of conveyance is also in favour of assessee. Further, keeping in view the fact that the assessee has paid more than 20% of the demand, we are inclined to grant stay on recovery of balance demand for a period of 180 days from the date of this order or till the disposal of the corresponding appeal, whichever is earlier. With the consent of both the parties, the corresponding appeal is fixed for hearing, on out of turn basis, on 17.11.2025. Paper books, if any, must be filed sufficiently ahead of the date of hearing. 5. In the result, the stay application is allowed as indicated above. Order pronounced in the open court on 17.10.2025.
