ABDUL REHIM, J. ------------------------------------------------- W.P.(c) No. 17127 OF 2013 ------------------------------------------------- DATED THIS THE 8th DAY OF JULY, 2013 J U D G M E N T Aggrieved by orders of re-assessment issued for the years 2005-2006 and 2006-2007 under Section 143 (3) read with Section 147 of Income Tax Act, 1961, the petitioner had approached the statutory appellate authority (2nd respondent) in Exts.P2 and P6 appeals. Exhibits P4 and P7 are the stay petitions filed before the 2nd respondent. From the endorsement contained in Exts.P4 & P7 it is evident that the stay petitions were received at the office of the 2nd respondent on 05-07-2013. The petitioner is aggrieved by the demand notices issued as per Ext.P3 and steps of recovery threatened, pending disposal of the appeals and the stay petitions. Hence the petitioner is approaching this court. 2. Heard; Senior counsel appearing for the petitioner as well as Standing counsel appearing for Government of India (Taxes). Considering pendency of the W.P.(c) No.17127/2013 -2- interim applications before the statutory authority, I am of the view that a direction for speedy disposal of Exts.P4 & P7 will suffice to meet the ends of justice. 3. Therefore the writ petition is disposed of directing the 2nd respondent to consider and pass orders on Exts.P4 & P7 stay petitions, after affording an opportunity of hearing to the petitioner as well as to the Department, at the earliest possible, at any rate within a period of one month from the date of receipt of a copy of this judgment. 4. Till such time the stay petitions are considered and disposed of by the 2nd respondent, coercive steps of recovery if any initiated pursuant to Ext.P3 notice shall be kept in abeyance. Sd/- C.K.
