Perused the records and heard learned Representative for the assessee and learned departmental representative. 3. On perusal of the Tribunal’s order dated 27.07.2017, it is noted that the assessee’s appeal was dismissed ex parte in limine due to non-prosecution. In Assessee by Sh. The applicant has accordingly prayed for recall of the ex parte order in the interest of justice, so as to afford an opportunity of hearing on merits. An affidavit of applicant is also placed on record deposing the aforesaid fact, which stands un-controverted by the Revenue. We, therefore, are satisfied that the assessee was prevented by sufficient cause from appearing before the Tribunal on the scheduled date of hearing. Accordingly the misc. application is liable to be allowed. 4. In the result, miscellaneous application is allowed. Ex parte order dated 27.07.2017 is set aside and the appeal is restored to its original number. Registry is directed to put up the matter with regular Bench in due course.
