P1 assessment order under the Kerala Value Added Tax Act, the petitioner has preferred an appeal before the appellate authority. Ext.P2 is the order of the appellate authority. Aggrieved by the order of the appellate authority, the petitioner has preferred Ext.P3 appeal together with Ext.P4 stay petition before the 3rd respondent. It is the case of the petitioner that even prior to considering the stay petition, recovery steps are taken by the respondents against the petitioner for recovery of the amounts confirmed against the petitioner by the assessment order through the issuance of Ext.P5 prohibitory order by the 4th and 5th respondents. 2. I have heard the learned counsel for the petitioner and also the learned Government Pleader for the respondents. 3. On a consideration of the facts and circumstances of the case as also the submissions made across the Bar, I dispose the writ petition with the following directions: i) The 3rd respondent shall consider and pass orders on Ext.P4 stay petition within a period W.P.(c).No.16866 of 2017 : 2 : of six weeks from the date of receipt of a copy of this judgment, after hearing the petitioner. ii) Recovery steps for recovery of amounts confirmed against the petitioner by Ext.P1 assessment order including further steps pursuant to Ext.P5 prohibitory order shall be kept in abeyance till orders are passed by the 3rd respondent as directed above. Iii) I make it clear that during the period when the stay order passed by this Court is in force, the petitioner shall be permitted to operate the bank account covered by Ext.P5.
