PADMAHSHALI, AM; This appeal of the assessee is assailed against the order of Commissioner of Income Tax (Appeals), [for short “CIT, (A)”] dt.14/12/2022 in National Faceless Appeal Centre (for short “NFAC”] passed u/s 250 of the Income-tax Act, 1961 [for short “the Act”] which dove out of assessment order dt.15/04/2021 passed u/s 143(3) of the Act was passed by the Assessing Officer, [for short “AO”] for the assessment year [for short “AY”] 2018-19. CTR Manufacturing Industries Pvt. Ltd., ITA No. 162/PUN/2023 AY: 2018-19 ITAT-Pune Page 2 of 2 2. At the outset, the Ld. AR referring to the application dt. 03/04/2023 has submitted that, the Ld. CIT(A) in the rectification proceedings u/s154 r.w.s. 250 of the Act has deleted the disallowance made u/s 14A of the Act, consequently the present appeal became infructuous hence it is prayed for withdrawal. We recording no objection from the learned departmental representative in allowing the withdrawal dismiss the present appeal. 3. In result, the appeal is dismissed as withdrawn.
