This assessee’s appeal for A.Y. 2016-17 is directed against the CIT(A)- 10,Pune’s order dated 07/08/2019 passed in case No.PN/CIT(A)-10 /ACIT,CPC-TDS/110,111,112,113,114,115,116,117,118,119/2018-19/426 involving proceeding u/s. 200A(1) r.w.s.194/A of the Income Tax Act, 1961; in short "the Act”. Heard both the parties. Case file perused. 2 ITA No.1630/PUN/2019 A.Y. : 2016-17 Pramod Janardan Shrotri, 2. It emerges at the outset that the assessee/appellant has filed a letter dated 10.10.2022 seeking adjournment on the ground although he has filed for settlement benefit under the Direct Tax Vivad Se Vishwas Scheme, 2020 and also filed Form-4 thereunder Form-5 is yet to be issued. Faced with this situation, we dismiss the assessee’s instant appeal at this stage; as withdrawn, subject to the conditin it shall be very much open for him to seek recall of our order in case the form-5 hereinabove is not issued for technical reasons.
